| Hindus held back by antiquated laws |

The citizens belonging to the Hindu community, who constitute nearly a tenth of Bangladesh’s 148-million-strong population, are held back by centuries-old customary laws which majority of them want to get updated suiting the modern socioeconomicmilieu. Many leading people in the  faith, who have moved for necessary reformers, regret that the State is yet to enact family code ensuring equal rights of the male and the female, although neighbouring countries have done the legal reform. A balanced progress of society is being decelerated due to those customary laws, for the women are being deprived of their natural rights and many complexities are arising out of such inhibitions. plight of thousands of Hindu women for deprivations, discriminations, complicacies and the absence of codified laws for a much-sought-after change. Members of the Buddhist community are in the same boat, as they also go by Hindu laws and customs.
Experts believe that most of the traditional laws are contradictory to the spirit of the constitution which says (Article 27), “All the citizens are equal before the law and are entitled to equal protection of law.”
“The State shall not discriminate against any citizen on grounds only of religion, race, caste, sex or place of birth,” says Article 28 (1) of the constitution. “Women shall have equal rights with men in all spheres of the State and of public life,” Article 28(2) says in further illustration.

BAF has lost 63 members
Low-quality China aircraft blamed for frequent crashes |

Air crashes have so far claimed lives of at least 63 trained or trainee pilots of the Bangladesh Air Force (BAF), official and unofficial sources said after the latest accident on Sunday.  The causes of almost half of the plane accidents could not be ascertained mainly due to lack of adequate evidence, said sources who were working with previous probe committees on the crashes. A total of 43 pilots were killed in training plane crashes before August in 2003, said a report placed at the parliamentary standing committee on defence ministry. Then chief of Air Staff

Air Vice-Marshal Fakhrul Azam submitted the report to the committee on August 19 in 2003 which was later placed at parliament.
Since then, 11 more accidents took place that claimed 18 more lives. A training aircraft crashed at Mahishpara village under Madhupur upazila in Tangail on Sunday, leaving its flying officer Sharif dead and Squadron Leader Mamun injured.

People started lodging criminal cases in hundreds against the perpetrators of war crimes soon after the present government assumed office in December 2008 with an electoral pledge to hold the trial of war criminals.
Stories remain untold, grievances unexpressed, offences unrecorded
But now it appears that the trial process has become isolated from the common people as the victims of war crimes have no opportunity to file cases or submit their grievances to the Dhaka-centric tribunal.
Most of the war victims have not got the opportunity to narrate their tales of unspeakable woes ...... Daily Sun

Enforced disappearance, extrajudicial killing rise

Distrust of and suspicion about law enforcers are increasing among people with the growing number of “forced disappearances” at a time when the whole nation has got the unique meaning of overused words “crossfire”, “encounter”, “shootout”, “gunfight”, which are essentially planned extrajudicial killings.
It is not clear whether or not BNP leader Ilyas Ali has been kidnapped by his enemies, but people have started to suspect it as an act of the law enforcers, as is also being alleged by his family members and political colleagues.
People’s suspicion of law enforcement agencies’ involvement is simply weakening the state. Different organisations are raising the issue in various international forums, including the UN, resulting in a diplomatic pressure and tarnishing of the country’s image. ...... Daily Sun |
Elected caretaker government
Politicians toss for peaceful polls

‘Elected caretaker government’ is the new formula currently being tossed by some politicians as a way out of the government-opposition standoff which appears to be at its insidious climax.
They think the new form of interim administration could help end the contentions a near-confrontational political situation, while maintaining the state principle of democracy enshrined in the constitution.
“The chief of such a caretaker government can be elected by the outgoing parliament. It can be done in two ways –either the way the president is elected or the way the prime minister assumes chief executive’s chair,” said a minister, spelling out their thinking. He said it is still too premature to propose, but explained the modality.
“At first, the political parties by consensus will name a set of neutral persons who can head caretaker government. Then the parliament will elect someone from among them to lead the interim administration,” he told daily sun.Presently, the leader of the political party having majority in parliament becomes prime minister. |
The president invites the leader of the house to form the government.
The policy analysts are suggesting that a provision can be incorporated into the constitution so that the parliament can elect the chief of interim government from the former chief justices or the former justices of the appellate division or from eligible members of the civil society.
According to the existing provisions under article 56 (2) and (3) of the constitution, only a parliament member can become Prime Minister, while only one-tenth of cabinet members can be chosen from technocrats.
This provision might be relaxed for appointing the chief adviser or other advisers of the neo caretaker government, said a ruling-party leader, who is considered an expert in constitutional affairs.
According to his propositions, a technocrat can become chief adviser, while other members of his or her cabinet may be appointed from the parliament members, who will lose the eligibility to contest the election they would supervise ............ Daily Sun |

On 8 August 2000, the High Court found a prisoner of Bogra District Jail not guilty and acquitted him of a murder charge on which he was sentenced to life-term imprisonment by a lower court. But the HC order could not make its way to the jail gate even in 12 years. He is still languishing in the prison. The unfortunate man is Abdul Mannan Yusuf of Sherpur upazila of the district. Many of Tarique Rahman's supporters in BNP lobbied for him to run in a parliamentary by-election in April 2009, but his mother Khaleda Zia felt it was too early for him to return home.

Major changes in constitution reprint
The government is reprinting the constitution with a massive change in it which may cause confusion, as all the changes are not specified in the Supreme Court (SC) verdict voiding the fifth amendment.
The SC, while directing protection of the basic fundamentals of the constitution and also in recovering its secular character, specified 10 places including the preamble, eight articles and paragraph 3A to the fourth schedule for changes. SC suggests punishment to
"martial laws" perpetrators
The Supreme Court has upheld the High Court verdict that scrapped the 5th Amendment of the Constitution suggesting "suitable punishment" to perpetrators of martial laws. The August 2005 High Court judgment had rendered illegal the regimes of martial dictators Ziaur Rahman, Khandaker Moshtaque Ahmed and Abu Sadaat Mohammad Sayem between August 15, 1975 and April 9, 1979.
